PLEASE READ THESE TERMS OF SERVICE CAREFULLY. By accessing or using Political Pay's services, you agree to be bound by these Terms of Service and all terms incorporated by reference.
If you do not agree to these terms, do not access or use our services. If you are accessing or using our services on behalf of a campaign, organization, or other legal entity, you represent that you have the authority to bind that entity to these terms.
"BlueRoot" (or "we," "our," or "us") refers to BlueRoot, Inc., a Delaware corporation with its principal place of business in Washington, DC.
"Services" refers to the BlueRoot platform, website, and all related services, features, applications, and content provided by BlueRoot.

1. Definitions
"BlueRoot" (or "we," "our," or "us") refers to BlueRoot, Inc., a Delaware corporation with its principal place of business in Washington, DC.
"Services" refers to the BlueRoot platform, website, and all related services, features, applications, and content provided by BlueRoot.
"User" (or "you" or "your") refers to any individual or entity that accesses or uses the Services.
"Campaign" refers to any political campaign, committee, organization, or cause that uses the Services to raise funds.
"Donor" refers to any individual who makes a contribution through the Services.
2. Account Terms
2.1 User Eligibility
To use the Services, you must be at least 18 years old and capable of forming a binding contract with Political Pay. If you are using the Services on behalf of a Campaign or other organization, you represent that you have the authority to bind that entity to these Terms.
2.2 Registration and Account Security
You are responsible for maintaining the security of your account and password. Political Pay cannot and will not be liable for any loss or damage resulting from your failure to comply with this security obligation. You are responsible for all activities that occur under your account.
2.3 Accurate Information
You must provide accurate and complete information when registering for an account and keep your account information updated. Political Pay reserves the right to verify the accuracy of any information you provide.
2.4 One Person, One Account
You may not create multiple accounts for the same person. Each user must have only one account, and each Campaign must have only one account.
3. Acceptable Use
3.1 Compliance with Laws
You agree to use the Services in compliance with all applicable laws, regulations, and these Terms. This includes, but is not limited to, campaign finance laws, election laws, and anti-fraud laws.
3.2 Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Using the Services for any illegal purpose or in violation of any local, state, national, or international law
- Violating or encouraging others to violate the rights of third parties, including intellectual property rights
- Interfering with or disrupting the Services or servers or networks connected to the Services
- Attempting to gain unauthorized access to the Services, other accounts, or computer systems or networks connected to the Services
- Collecting or harvesting any personally identifiable information from the Services, including account names
- Using the Services to transmit any malware, spyware, or other malicious code
- Impersonating another person or otherwise misrepresenting your affiliation with a person or entity
- Using the Services to make fraudulent contributions or engage in money laundering
- Using the Services to raise funds for hate groups, terrorist organizations, or other prohibited entities
3.3 Content Guidelines
You are solely responsible for all content that you upload, post, email, transmit, or otherwise make available via the Services. You agree not to post content that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
- Is hateful, or promotes discrimination, bigotry, racism, or harm against any group or individual
- Contains violent or threatening content or incites violence
- Contains false, misleading, or deceptive statements or omissions
- Infringes any patent, trademark, trade secret, copyright, or other intellectual property rights
- Contains unsolicited or unauthorized advertising, promotional materials, spam, or any other form of solicitation
4. Payment Terms
4.1 Fees
BlueRoot charges a fee of 3.95% plus $0.30 per transaction for processing contributions. These fees may be updated from time to time, and any changes will be posted on our website and communicated to users.
4.2 Payment Processing
Political Pay uses third-party payment processors to process contributions. By using the Services, you authorize Political Pay and its payment processors to charge your payment method for the contribution amount plus applicable fees.
4.3 Refunds
All contributions made through the Services are final and non-refundable by Political Pay. However, Campaigns may issue refunds at their discretion, subject to applicable campaign finance laws. Processing fees are non-refundable.
4.4 Chargebacks
If a Donor initiates a chargeback or payment reversal, Political Pay reserves the right to recover the disputed amount and any associated fees from the Campaign that received the contribution.
4.5 Taxes
You are responsible for determining what, if any, taxes apply to your contributions or receipts through the Services. Political Pay is not responsible for determining, collecting, reporting, or remitting any taxes arising from any transaction.
5. Campaign Finance
5.1 Compliance Responsibility
Campaigns are solely responsible for complying with all applicable campaign finance laws and regulations, including but not limited to registration requirements, contribution limits, source prohibitions, and reporting obligations.
5.2 Donor Eligibility
Donors must meet all legal eligibility requirements to make political contributions. For federal campaigns in the United States, this generally means that Donors must be U.S. citizens or lawfully admitted permanent residents. State and local campaigns may have different requirements.
5.3 Contribution Limits
Donors and Campaigns are responsible for ensuring that contributions do not exceed applicable contribution limits. Political Pay may implement certain automated checks, but these are not a substitute for your own compliance efforts.
5.4 Reporting
Political Pay will provide Campaigns with the information necessary to comply with reporting requirements, but Campaigns are solely responsible for filing accurate and timely reports with the appropriate regulatory authorities.
5.5 Prohibited Sources
Contributions from prohibited sources, such as foreign nationals (for federal campaigns), government contractors, or corporations (where applicable), are not permitted. Political Pay reserves the right to reject or refund any contribution that appears to come from a prohibited source.
6. Intellectual Property
6.1 Political Pay Intellectual Property
The Services and all content and materials included on or within the Services, including, but not limited to, text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are the property of Political Pay or its licensors and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.
6.2 Limited License
Political Pay grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for their intended purposes, subject to your compliance with these Terms.
6.3 User Content
You retain all rights to any content you submit, post, or display on or through the Services. By submitting, posting, or displaying content on or through the Services, you grant Political Pay a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with providing and promoting the Services.
6.4 Feedback
If you provide Political Pay with any feedback or suggestions regarding the Services, you hereby assign to Political Pay all rights in such feedback and agree that Political Pay shall have the right to use such feedback in any manner it deems appropriate.
6.5 DMCA Compliance
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please contact our designated copyright agent at [email protected] with the following information:
- A description of the copyrighted work that you claim has been infringed
- A description of where the material that you claim is infringing is located on the Services
- Your address, telephone number, and email address
- A statement by you that you have a good faith belief that the disputed use is not authorized
- A statement by you, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf
7. Privacy
Your privacy is important to us. Please review our Privacy Policy at politicalpay.com/privacy to understand how we collect, use, and share your information. The Privacy Policy is incorporated into these Terms by reference.
8. Disclaimers
8.1 Service Provided "As Is"
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. POLITICAL PAY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
8.2 No Guarantee of Availability
POLITICAL PAY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS IN THE SERVICES WILL BE CORRECTED.
8.3 No Legal or Compliance Advice
POLITICAL PAY DOES NOT PROVIDE LEGAL OR COMPLIANCE ADVICE. ANY INFORMATION PROVIDED BY POLITICAL PAY REGARDING CAMPAIGN FINANCE LAWS OR OTHER LEGAL MATTERS IS FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE CONSTRUED AS LEGAL ADVICE. YOU SHOULD CONSULT WITH YOUR OWN LEGAL COUNSEL REGARDING YOUR SPECIFIC LEGAL OBLIGATIONS.
8.4 Third-Party Content and Services
POLITICAL PAY DOES NOT ENDORSE, WARRANT, OR GUARANTEE ANY THIRD-PARTY CONTENT OR SERVICES ACCESSIBLE THROUGH OR LINKED TO THE SERVICES, AND POLITICAL PAY SHALL NOT BE A PARTY TO OR IN ANY WAY RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES.
9. Limitation of Liability
IN NO EVENT SHALL POLITICAL PAY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT POLITICAL PAY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT POLITICAL PAY SHALL NOT BE LIABLE FOR USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
10. Indemnification
You agree to defend, indemnify, and hold harmless Political Pay, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Services.
11. Termination
11.1 Termination by You
You may terminate your account at any time by following the instructions on the Services or by contacting customer support at [email protected].
11.2 Termination by Political Pay
Political Pay may terminate or suspend your account and access to the Services at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
11.3 Effect of Termination
Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11.4 Data Retention
Following termination or deactivation of your account, Political Pay may retain your information for a commercially reasonable time for backup, archival, or audit purposes, or as required by law. Any contributions processed before termination will be completed, and all applicable fees will still apply.
12. Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions.
12.2 Arbitration
Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Washington, DC, using the English language in accordance with the Arbitration Rules and Procedures of JAMS then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes.
12.3 Class Action Waiver
YOU AND POLITICAL PAY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
12.4 Exceptions
Notwithstanding the foregoing, Political Pay may seek injunctive or other equitable relief to protect its intellectual property rights in any court of competent jurisdiction.
13. Amendments
Political Pay reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
14. Miscellaneous
14.1 Entire Agreement
These Terms constitute the entire agreement between you and Political Pay regarding the Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter of these Terms.
14.2 Waiver
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and Political Pay's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
14.3 Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
14.4 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without Political Pay's prior written consent. Any attempt by you to assign or transfer these Terms without such consent shall be null and void. Political Pay may freely assign or transfer these Terms without restriction.
14.5 Notices
Any notices or other communications provided by Political Pay under these Terms will be given by posting to the Services or by email to the address you provide during registration. Notices to Political Pay should be sent to [email protected].
14.6 Force Majeure
Political Pay shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
